Eligibility
These requirements apply unless a competition announcement lawfully imposes an additional prize-specific restriction.
Who may enter?
Versus Finance competitions are open only to individuals aged 18 or over who live in Jersey at the time of entry and when the prize is awarded.
Entrants must provide accurate and complete information. Versus Finance may require reasonable proof of identity, age and Jersey residency before awarding a prize.
Who may not enter?
Directors and employees of Versus Finance Limited, anyone directly involved in organising or administering the competition, and their immediate family members may not enter.
Versus Finance may also exclude any person whose participation would create an actual or perceived conflict of interest.
What if eligibility cannot be confirmed?
If a selected winner does not provide reasonably requested evidence within the stated time, is found to be ineligible, or supplied inaccurate information, Versus Finance may withdraw the award and select an alternative winner using the same fair method.
Entering a Competition
The relevant competition announcement supplies the details that are unique to that promotion.
What information will each competition provide?
Each competition announcement will identify the prize, opening and closing dates, entry method, permitted number of entries, winner-selection method and any prize-specific restrictions. Those details form part of the terms for that competition.
If a clearly stated competition-specific detail differs from these general terms, that detail applies only to the relevant promotion. The remaining general terms continue to apply.
Is a purchase or application required?
No purchase, finance application or payment is necessary to enter a Versus Finance competition.
When is an entry valid?
An entry must be submitted using the method, within the dates and in accordance with the entry limit stated in the competition announcement. Entries received after the closing time, or by another method, may be rejected.
Versus Finance is not responsible for entries that are delayed, lost, incomplete or not received because of technical, communications or platform failures outside its reasonable control.
Selecting & Contacting Winners
Winners will be chosen fairly using the method stated in the relevant competition announcement.
How will a winner be selected?
A prize draw winner will be selected using a verifiably random process or under appropriate independent supervision. A judged competition will be assessed against the stated criteria by an independent judge or by a judging panel that includes an independent member.
The selection method will be appropriate to the type of competition and applied consistently to all valid entries.
How will a winner be contacted?
Versus Finance will make reasonable attempts to contact the selected winner using the contact method or social-media account associated with the entry. Entrants are responsible for monitoring that contact method, including message-request and junk folders.
How long does a winner have to respond?
Unless the competition announcement specifies a longer period, a selected winner must respond within seven days of the first notification and complete any reasonable eligibility checks.
If no response is received after reasonable contact attempts, the winner declines the prize or eligibility cannot be confirmed, Versus Finance may select an alternative winner using the same method.
Prizes & Collection
The competition announcement will describe the prize and explain how it is to be received.
Can a prize be transferred or exchanged?
Prizes are personal to the winner, non-transferable and not exchangeable for cash. A winner may not sell or assign the right to receive a prize before it is awarded.
What if the advertised prize becomes unavailable?
If circumstances outside Versus Finance's reasonable control make the advertised prize unavailable, Versus Finance may provide a substitute of equivalent or greater value. Any substitute will be reasonable and will not materially disadvantage the winner.
How will the prize be received?
The competition announcement or winner notification will explain whether the prize must be collected or will be delivered. The winner is responsible for any travel, accommodation, personal expenses or other costs not expressly included in the prize description.
Where a prize is supplied by a third party, reasonable supplier terms may also apply and will be brought to the winner's attention.
What applies to age-restricted prizes?
A winner must provide satisfactory proof of age before receiving alcohol or another age-restricted prize. No age-restricted prize will be supplied where doing so would be unlawful.
Announcements & Publicity
Winner information is handled proportionately so that a valid award can be demonstrated while respecting individual rights.
Will the winner's name be announced?
Entrants are informed before entry that Versus Finance may publish or make available the winner's full first name and surname to confirm that a valid award took place.
A winner may object to publication or request that the amount of information published be reduced. Versus Finance will consider the request fairly, but may still provide information to a regulator or other competent authority where required.
May Versus Finance use photographs or videos?
Photographs, video, audio, testimonials, a full profile or other broader promotional use will require the winner's separate written permission. Any request will explain the media, purpose and intended use.
Refusing wider publicity will not invalidate a prize that has been fairly won.
How will entrant details be used?
Contact and entry details will be used only as reasonably necessary to administer the competition, validate entries, select and contact winners, deliver prizes, resolve queries and keep appropriate administration records.
Entering a competition will not automatically add an entrant to a marketing list. Any marketing communication requires an appropriate separate basis.
Social Media Competitions
Additional safeguards apply when a competition is promoted through a third-party social platform.
Is the social platform responsible for the competition?
Unless expressly stated otherwise, a competition promoted through Facebook, Instagram or another social platform is not sponsored, endorsed, administered by or associated with that platform.
To the extent permitted by law, entrants release the relevant platform from responsibility arising from the administration of the competition. Versus Finance Limited is the promoter and is responsible for the promotion.
What social-media rules apply?
Entrants must comply with the relevant platform's lawful terms and must not use false accounts, automated activity, impersonation or other methods intended to manipulate engagement or the selection process.
Versus Finance is not responsible for a platform removing an entry or account, restricting messages, or experiencing an outage outside Versus Finance's reasonable control.
Fair Administration
These provisions help Versus Finance administer promotions consistently and protect genuine entrants.
When may an entry be rejected or disqualified?
Versus Finance may reject an entry or disqualify an entrant where it reasonably believes that the entry is late, incomplete, incorrectly submitted, fraudulent, unlawful, abusive or offensive; contains false information; exceeds the permitted entry limit; uses automation or duplication; manipulates the promotion; infringes another person's rights; or otherwise breaches the applicable terms.
Any decision will be made reasonably, consistently and with regard to available evidence.
Can a competition be changed or cancelled?
Versus Finance may suspend, amend or cancel a competition where circumstances outside its reasonable control make this necessary, including serious technical failure, platform disruption, fraud, legal or regulatory requirements, or the unavailability of a prize.
Where practicable, Versus Finance will explain the change, minimise disappointment and treat entrants fairly. These terms will not be changed retrospectively merely to avoid awarding a valid prize.
What responsibility is limited?
Versus Finance is not responsible for loss, delay or failure caused by events outside its reasonable control, or for indirect or unforeseeable loss arising from entry into a competition or use of a prize.
Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability or statutory right that cannot lawfully be excluded or limited.
