Terms of Business

These Terms of Business explain the relationship between Versus Finance Limited and its clients. They set out how our services work, what clients can expect from us and the responsibilities that apply when using our services.

Who is Versus Finance?

Versus Finance Limited is registered in Jersey under company number 123690. The company register is administered by the Jersey Financial Services Commission (JFSC).

Its registered business address is De Carteret House, 7 Castle Street, St Helier, Jersey JE2 3BT.

Data-protection registration: Versus Finance Limited is registered with the Jersey Office of the Information Commissioner (JOIC) under registration number 58024.

These are company and data-protection registrations respectively.

What do these Terms of Business cover?

These Terms of Business govern your use of the Versus Finance Limited website and the finance-broking and introduction services that we provide. When you submit an application, the required Terms of Business acceptance confirms that you have read and accepted these terms.

What services does Versus Finance provide?

We act as a finance broker and credit introducer. For mortgages, our role is limited to introducing clients to third-party mortgage providers; we do not act as the mortgage broker. We may also introduce clients to other lenders, finance providers and, where relevant, insurers.

We are a broker, not a lender. We do not provide legal, tax or independent financial advice. Any lending or product agreement is entered into directly between the client and the relevant provider.

The relevant lender or provider decides whether to approve an application and is responsible for its pricing, terms and completion timescales.

Is Versus Finance required to progress every application?

No. We may decline, pause or stop an application if required information is missing, checks cannot be completed or no suitable lender is available.

Does Versus Finance search the whole market?

No. We work with a carefully selected panel of established banks and regulated lenders. We do not search the whole market, and we do not place business with unregulated lenders. The options we present will depend on the information supplied, the client’s circumstances and the lenders available to us.

Are calculators and illustrations guaranteed?

No. Actual rates, repayments and terms depend on the client’s circumstances.

How do Versus Finance arrangement fees work?

The applicable Versus Finance arrangement fees are shown below:

No GST is added to these arrangement fees.

When is the fee payable? An arrangement fee becomes payable when the client signs the relevant loan, finance or mortgage agreement.

Once signed, the fee remains due even if the client later decides not to draw down the funds or complete the transaction, unless Versus Finance Limited confirms otherwise in writing.

Late payment: Payment is due within 30 days of invoice. Unpaid fees may be subject to recovery action, including legal proceedings.

Can the fee be reduced or waived? Versus Finance Limited may reduce or waive an arrangement fee at its discretion.

Payment: We do not accept cash. Arrangement fees must be paid by bank transfer or another payment method confirmed by Versus Finance Limited.

Additional work: If a client asks us to provide work outside our usual broking or introduction service, an additional fee may apply.

Could a lender or another third party charge separate fees?

Yes. A lender, valuer, solicitor, insurer, credit-reference agency or other third party may apply its own fees or charges. These are separate from the Versus Finance arrangement fee and are governed by that third party’s terms.

Where a third-party charge is known to us, we will explain it or direct the client to the relevant provider’s documentation before the client proceeds.

Does Versus Finance receive commission?

Versus Finance Limited may receive commission or other remuneration from a lender, provider, insurer or business to which it introduces a client. Where disclosure is required or relevant to the transaction, the nature or amount of that commission will be disclosed in writing.

Commission received from a provider is separate from any Versus Finance arrangement fee payable by the client.

What information must a client provide?

Clients must provide complete, accurate and up-to-date information and promptly tell us if their circumstances change. Clients must not knowingly or recklessly provide false, misleading or incomplete information.

Are identity and fraud checks required?

Yes. Clients must provide information and documents needed for identity, fraud-prevention, sanctions, anti-money-laundering and other compliance checks. We may pause or stop work if checks cannot be completed.

How is personal information handled?

We process personal data in accordance with our Privacy and Cookie Policy. Lenders, providers and other parties involved in an application will also process information under their own privacy notices.

How will Versus Finance communicate with clients?

We may communicate by telephone, email, post, secure electronic systems or in person. Clients are responsible for keeping their contact information current and for checking communications relating to their application.

What law governs these terms?

These Terms of Business are governed by the laws of Jersey, Channel Islands. Subject to any rights that cannot lawfully be excluded, the Jersey courts will have jurisdiction over disputes arising from these terms or our services.

Will the website always be available?

No. Access may be interrupted for maintenance, updates or technical reasons. We do not guarantee continuous or error-free availability.

Can clients rely on website information?

Website information is general only and is not an offer or legal, tax or independent financial advice. Products, rates and criteria can change, so clients should verify information before acting.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

How are intellectual property, website security and changes handled?

The VERSUS FINANCE trade mark is registered in the United Kingdom under number UK00003826997. The Versus Finance name, logo, website design and original content are protected intellectual property and may not be copied or used without written permission. Users must not attempt to compromise the website, introduce malicious code or use the website unlawfully.

We may update these terms when our services, fees, legal obligations or business practices change. The current version and its update date will be published on this page. Material fee changes will not be applied retrospectively to a transaction already accepted unless the client agrees in writing.
