Versus Finance Ltd is registered with number 58024 under the Data Protection (Jersey) Law 2018 and Data Protection (Authority) Jersey Law 2018, effective from 25th May 2018, following the EU General Data Protection Regulation (GDPR).

This Privacy Notice is a statement of how we, as a business entity, apply data protection principles and explains how we collect, use, disclose, and safeguard your personal information to ensure compliance with privacy regulations.

I. Who is collecting your data

Versus Finance Ltd is a privately owned Jersey-registered company holding a business license to undertake finance/mortgage brokerage services.

Versus Finance Ltd is registered with the Jersey Financial Services Commission under number 123690. However, it is not currently undertaking regulated activities in Jersey. Consequently, the protections provided under the JFSC regulatory system does not currently apply to users of our services.

Versus Finance Ltd is registered with the Jersey Office of the Information Commissioner under number 58024.

II. What data is being collected

The personal information we collect from you depends on the nature of your enquiry, the type of product, and the service you are enquiring about. To satisfy any contractual, legal, or statutory obligations, we will collect the following personal data about you, your representatives, family members, and/or your business entity:

  • Personal Identification Information: Name, address, email, phone number, date of birth, etc.
  • Financial Information: Income details, credit history, bank statements, etc.
  • Employment Information: Employer details, job title, employment history, etc.
  • Business Information: Company name, business address, business financials, etc.
  • Other Relevant Information: Any additional information necessary to provide our services effectively.

III. How is your personal data collected

We use various methods to collect data from and about you, your family members, associates, or business entity, including personal information collected from:

  • Direct Interactions: By providing us with your data directly by hand, completing an application/enquiry form via our website or via an introducer, or by corresponding with us by post, phone, email, or otherwise. This includes requests for information or completing a survey.
  • Indirect Interactions: Following an introduction to us by another party such as a private individual or a business entity, an accountancy firm, law firm, or management consultancy, amongst others.
  • Public Databases: We may obtain information about individuals and/or business entities from public databases. We use reputable sources such as the Electoral Register and/or the Jersey Financial Services Commission Companies Registry.
  • Data from Outside Organisations: We may also obtain information from companies that introduce you or a business entity to us (e.g., dealerships or retailers offering or introducing finance through us), financial advisers, comparison websites, and social media networks.

PLEASE NOTE THE FOLLOWING ABOUT JOINT APPLICANTS: If you are applying jointly or have a spouse, partner, guarantor, or joint hirer, please be aware that the finance companies/banking institutions we share your data with will link your records. We recommend discussing this Privacy Policy with them before submitting your credit/mortgage application. Credit Reference Agencies (CRAs) will also link your records, and these links will remain until both parties successfully apply for disassociation with the CRAs.

IV. Consequences of not providing your data

You are not obliged to provide your personal information to Versus Finance Ltd. However, as this information is required for us to provide you with our services and to pursue our legitimate interests, we will not be able to offer some or all of our products or services without it.

V. What is the legal basis for processing the data

To process your information, we rely mainly on the following legal bases:

  • Performance of a Contract: The use of your information is necessary to perform the contract that you, the joint hirer, guarantor, or your legal representative has with us. This includes processing your personal information when the data subject initiates activities with us as the data controller, permitting processing even before entering into a contract (pre-contractual relations).
  • Consent: We may rely on your consent to use your personal information for certain products. We may also rely on consent to obtain special category data (such as medical/health data). If required, we will seek explicit consent to legitimate the processing of special category data before proceeding. Additionally, we may rely on consent for direct marketing purposes. You may withdraw your consent at any time by contacting us using the details provided at the end of this policy.
  • Legitimate Interests: We may use your information for our legitimate interests, such as providing you with the most suitable loan/credit /mortgage product, enhancing website experience, sending emails, or improving and promoting our products and services. This also includes administrative purposes, fraud prevention and detection, and legal purposes, which encompass:
    • Acting as a finance/mortgage broker in arranging and introducing credit/mortgage agreements and fulfilling those agreements, including servicing and settlements.
    • Preventing and detecting fraud and financial crime.
    • Ensuring public safety and crime prevention.
    • Complying with international sanctions.
    • Combating fraud and terrorist financing.
    • Maintaining network and information security.

VI. Who will your personal information be shared with

We may share and disclose your personal information with the following third-party service providers:

  • Finance Companies/Banking Institutions: We may transfer and submit your information to finance companies/banking institutions with whom we have a business relationship as part of our role as brokers /introducers .
  • Authorized Representatives: Individuals acting on your behalf with the authority to do so, such as debt charities, power of attorney holders, lawyers, advocates, conveyancers, or your professional advisors.
  • Credit Reference Agencies (CRAs) and Fraud Prevention Agencies (FPAs): The finance companies/banking institutions we approach will use these agencies to perform credit and fraud searches, verify your identity, and assess your application. This processing is necessary due to legitimate interests (e.g., fraud prevention and responsible lending) and compliance with our finance providers’ legal obligations. These searches will be recorded by the finance companies/banking institutions we approach. Additionally, Versus Finance Ltd may also perform credit and fraud searches to ensure thorough assessment and compliance.
  • Legal and Regulatory Bodies: Such as the respective departments of the States of Jersey, law enforcement, government bodies, the respective Data Protection Offices of the Channel Islands, fraud prevention agencies, our professional advisers, and auditors when we have a legal, regulatory, or technical obligation to do so.
  • Business Support Service Providers: Such as our IT providers who assist us in hosting, transferring, testing, securing, and resolving problems. This enables us to provide you with the services and products you need. We may also share information with third-party audit companies that provide expertise and assurance over our processes and controls, as well as with repossession agents, property surveyors, advocates, solicitors, and conveyancing providers. This process is undertaken as it is necessary for the performance of our own services and/or those of the finance companies/banking institutions with whom we have a business relationship.
  • Third-Party Acquirers: If we are acquired by a third party, personal data held by us about you may be disclosed and otherwise transferred to the acquiring, successor, or assignee entity as part of any merger, acquisition, sale of assets, or similar transaction, provided the recipient commits to a Privacy Policy that has terms substantially consistent with this Privacy Notice.
  • Other Companies/Organisations: Companies you request us to share your data with.

VII. How We Use Your Personal Data Information

The core purposes for which we may use your information are as follows:

  • Assessment of Suitability: To recommend, assess, understand, and determine your eligibility for a credit/mortgage facility, whether for you or your company.
  • Data Submission: Acting as a broker, Versus Finance Ltd needs to identify the source and submit relevant personal data to partner finance companies/banking institutions to obtain or facilitate a loan and/or a mortgage. Providing this information to third parties is essential for progressing any inquiry or application made on your behalf and addressing any additional questions or administrative issues raised by these finance providers/banking institutions.
  • Legitimate Business Interests: Where necessary for our legitimate business interests, we may use your data for:
    • Improving customer service.
    • Conducting market research (data will be anonymised).
    • Quality assurance and staff training.
    • Marketing (where permitted to send promotional information).
    • System development and statistical analysis of your personal data, even if your application is declined by us or one of our partner finance providers/banking institutions, or if you choose not to complete your application with us or our partners.
  • Credit and Fraud Searches: We and/or our partner finance companies/banking institutions may perform searches with Credit Reference Agencies (CRAs) and/or Fraud Prevention Agencies (FPAs). In considering whether to enter you into a credit or mortgage agreement, our partner finance provider/banking institution may use your personal data to conduct a credit check on you and/or your business. They may search personal records at credit reference agencies that may be linked to your spouse/partner or others with whom you are financially associated (“associated records”), and you may be assessed with reference to these records. You can contact us for a full list of the credit reference agencies used for this purpose.
  • Repayment Evaluation: To understand, evaluate, and determine your ability to repay the credit/mortgage facility you are seeking through us.
  • Loan Administration: To administer, request, and process any changes or mid-term adjustments to credit/mortgage agreements arranged through us.
  • Information Provision: To provide you with information, products, or services that you request from us or which we feel may interest you (with your consent).
  • Query Response: To respond to any queries you may have regarding any credit/mortgage product agreement you have taken through us, or to inform you of any developments related to those products and agreements of which we might become aware.
  • Partner Requests: To respond to requests from our partner finance companies/banking institutions and or they’re our compliance service provider regarding the advice we have given to you or to contact you for feedback on the service you received from us or our partners.
  • Data Storage: To record and store your personal data securely in our paper files, mobile devices, computer systems, email, hard drives, and cloud facilities.
  • Fraud Prevention: For fraud and financial crime prevention and detection, and for legal purposes where we may need to use your information or respond to legal disputes, regulatory investigations, or compliance purposes.
  • Service Improvement: To develop and improve our services to you.
  • Regulatory Compliance: To meet any legal and regulatory compliance and reporting obligations. Your information may be stored securely on-site and in a cloud-based system whose servers are located within the EEA.

In each case, your personal data will only be used for the purposes outlined in this Privacy Notice (i.e., to progress your loan/mortgage inquiry) and to provide you with our professional services. Furthermore, when you provide us with personal information belonging to a third party, you must have obtained the necessary consents to disclose their information and have provided them with a copy of this notice confirming they have not objected to such use of their personal data.

VIII. Special Categories of Data (if applicable)

Due to the services we offer, we may occasionally need to request sensitive personal information from you (e.g., medical treatment loans) where necessary. When we collect sensitive personal information, we will only request the information required for the specified purpose and will always seek your explicit consent. You have the right to modify or withdraw your consent at any time, and we will act on your request promptly unless there is a legitimate interest or legal reason for not doing so.

IX. How Long Will Personal Information Be Stored

We only keep your personal information for as long as necessary or as required by regulations.

  • Contracted Services: If an inquiry or quote results in a contract/agreement, we have a retention policy of 10 years from the date of signing the agreement. After this period, all data will be securely disposed of.
  • Quotes/Enquiries/Business Not Incepted: If an inquiry or quote is not proceeded with or does not result in a contract/agreement, we will retain your data for 12 months. After this period, all data will be securely disposed of.
  • Third-Party Finance Companies/Banking Institutions: If your personal information is shared with a third-party finance company or banking institution, each company will have its own retention policies. You should refer to the original copy of the finance company/banking institution privacy notice received at the time we collected your personal information and/or the copy of the credit/mortgage agreement document for further details.

X. What Rights Does the Data Subject Have

To ensure data subjects feel assured of the protection and privacy of their personal information, they are empowered with certain rights. These rights allow data subjects to make specific requests and ensure that their personal data is not misused for purposes other than those for which it was originally provided.

  • Right to Information: Allows the data subject to request information about what personal data is being processed and the rationale for such processing.
  • Right of Access: Enables the data subject to access personal data that is being processed. Data subjects can view their personal data and request copies of it.
  • Right to Rectification: Allows the data subject to request modifications to their personal data if they believe it is not up to date or accurate.
  • Right to Withdraw Consent: Provides the data subject with the ability to withdraw previously given consent for the processing of their personal data for a specific purpose. Upon withdrawal, the company must stop processing the personal data based on the earlier consent.
  • Right to Object: Enables the data subject to object to the processing of their personal data.
  • Right to Object to Automated Processing: Allows the data subject to object to decisions based solely on automated processing. For instance, a customer may request that their loan application be reviewed manually.
  • Right to be Forgotten (Right of Erasure): While we will adhere to the right to be forgotten, there may be cases where it is not possible to erase personal data, such as when we or our third-party service providers are legally required to maintain information for a specific period. We will inform you of the information that will be retained, and upon request, we can provide details about the legal obligations that require us to do so.
  • Right to Data Portability: Enables the data subject to request the transfer of their personal data. Data subjects may ask for their personal data to be provided back to them or transferred to another controller. The data must be provided or transferred in a machine-readable electronic format.

A rights request can be made by the individual or their legal representative. Such individuals may include customers, clients, employees of Versus Finance Ltd, or personnel of a supplier working for the company. The data subject should typically make requests in writing.

XI. How We Protect Your Personal Information

We have implemented physical, electronic, and procedural safeguards to protect your personal information. Access to your data is authorised only for employees and trusted partners who require it to perform their responsibilities. They will process your personal information only according to our instructions and are bound by a duty of confidentiality.

This website employs 128-bit Secure Sockets Layer (SSL) encryption technology, which provides industry-standard levels of security. It also holds a Hypertext Transfer Protocol Secure (HTTPS) certificate. However, as a responsible business entity, we advise against sending any sensitive information over an unsecured internet connection.

We have established procedures to address any suspected data security breaches and will notify you and any applicable regulators of a suspected breach where we are legally required to do so.

XII. International Transfers

While we primarily operate within the Channel Islands and the European Economic Area (EEA), we may need to transfer your personal data to third-party service providers or business partners outside these jurisdictions.
